Rush Creek is not a Condominium - You own the property on which your home sits.  This includes the front and back yard, sidewalk, driveway, etc.  Exterior repairs are the homeowner's responsibility.  Rush Creek collects for the painting of homes, long-term shingle replacement, gutter cleaning, and common area maintenance and repair.  All other repairs are the homeowner's responsibility.

Addresses - It is strongly suggested that you place an identifying address on your back fence post (assuming you have one).  This way repairmen (and firemen in case of an emergency) can identify the correct unit.  This would save the confusion of trying to count the units from the end and hoping you have found the correct one.

Care of Pets - For the protection of the dogs, their owners and our other residents we request (and a City Ordinance dictates) that dogs are always on a leash.  We all know that all pets need to go to the bathroom so please clean-up after them. Maryland Heights City ordinance no. 88-236, paragraph 7 states, “The owner of every animal shall be responsible for the removal of any excreta deposited by his animal on public walks, recreation areas, or private property”.  Simply put, this means everywhere in Rush Creek.  We will all be happier if we don’t step in pet poop in our front or back yards, the parking islands or in the other common grounds.

Common Grounds -The common grounds in Rush Creek are all grounds except the front and back yards of each individual unit. Digging, dumping, sawing or parking are not permitted on the common grounds. Please be nice to our neighbors and our environment. Do not use the Pheasant Run common grounds (the grounds adjacent to the north side of Rush Creek Way) for dumping.

Decks - Please inspect your deck to make sure it is securely attached to your home.  Three different decks in the subdivision have pulled away and partially collapsed in the past. Most decks were installed over 30 years ago and may need to be attached more securely.

For Sale and for Rent Signs - To assist our owners in selling their property, we allow signs to be put in the front yard of the home for sale or rent. On weekends only, open house signs may be placed at the entrance to the subdivision during the time the home is actually open for showing to the public. Signs are not to be placed anywhere else.

Homeowner’s Insurance - For the protection of all owners from damage due to fire, smoke, water etc. our indenture requires that each owner must have homeowners insurance and Rush Creek Homeowners’ Association be named the 2nd insured on your insurance policy.

Parking Ordinances in Rush Creek - Parking is regulated by City of Maryland Heights Municipal Codes and adopted rules/regulations by the Rush Creek Board of Trustees. Indentures ARTICLE III, Sections 3 and 13.

Designated Parking on Common Area Streets and Parking Spaces - All common area parallel parking spaces in the Rush Creek Subdivision are striped to designate the area available for each vehicle.  A vehicle must be parked within space allotted (within the lines). The small areas painted may be utilized to park motorcycles.

All other common area parking in the Rush Creek Subdivision is marked with a concrete parking pad. One vehicle should be parked behind one concrete pad.

For your information, "No Parking Anytime" applies to:

Falling Brook, traveled roadway only*

Painted Leaf, traveled roadway only*

Quiet Stream, traveled roadway only*

Silent Spring, traveled roadway only*

* Refers to the all roadways that do not have striped parallel or indented parking pads.

Please be a courteous neighbor and respect the "one way only" sign at the entrance to each street.

Registration/Licensing - All vehicles parking in the subdivision common area streets and parking areas must have proper registration and validated license plates. City of Maryland Heights Municipal Code

Commercial and Recreational Vehicles - Commercial vehicles are not allowed to be parked or be stored in the subdivision, including private driveways. Commercial vehicles must be parked in the garage of the unit per the City of Maryland Heights Municipal Code.

Boats of any kind or recreational vehicles may not be stored or remain upon any of the streets, common grounds or the lots of this subdivision.

If the above said vehicles and boats are so stored or remain on the aforesaid premises, trustees shall take the necessary action to remove them. Indentures ARTICLE V, Section 9

Abandoned or Stored Vehicles - Abandoned cars, motorcycles, jeeps, trucks or motor vehicles of any kind whatsoever that is unable to move under their own power may not be stored or remain upon any of the streets, common grounds or the lots of this subdivision.

Cars, motorcycles, jeeps, trucks or motor vehicles of any kind whatsoever that have not moved for more than two (2) weeks on the aforesaid premises will be considered abandoned or stored and the trustees shall take the necessary action to remove them. Indentures ARTICLE V, Section 9.

Additional Parking Rules - Vehicles should not be parked on the grass areas along Rush Creek Way or any common ground.

Vehicles should be parked “completely” within the area of the designated garage drive entrance.  No part of the vehicle should extend into the main drive.

Vehicles should not park on parts of the island not marked for parallel parking, except for temporary loading or unloading purposes.

Request for Exterior Modification - Applications for exterior modification and/or additions or alterations are available from Joe Decker or you can download the forms below. Completed application with a $100 refundable deposit is to be returned to the Rush Creek Board of Trustees. Approval, in writing, must be obtained from the Rush Creek Board and the City of Maryland Heights BEFORE MAKING ANY CHANGES.

Some homeowners have been adding boards at the seams between sections of siding and/or at the top or bottom of siding.  No vertical boards may be added, and no horizontal boards in excess of four inches wide may be used. One horizontal board may be used at the top & bottom sections of siding. The boards in discussion are to be used only to fasten the siding to the frame of the home. The boards will not be used to cover bad or deteriorating siding.

It is the homeowner's responsibility to make repairs and maintain their homes. Rush Creek budgets for the painting of maintained homes--Rush Creek does not pay for home repairs.

Safety & Security in Rush Creek -The Maryland Heights Police Department will check on your home while you are gone. If you are interested in this service contact the Police Department before you leave on your trip. Also they tell us that a simple but effective way of protecting our homes from burglars is to keep outdoor lights on at night. Consider using movement-activated or dusk to dawn lighting both in front of and behind your home. These lights will welcome you home and deter prowlers. It is also very important that your garage door remains closed day and night.

Safety Tips from the Maryland Heights Fire Marshall

Have your furnace checked and serviced.

Clean and inspect your fireplace or wood stove flue and chimney.

Never use a fireplace to dispose of trash or rubbish.

Check for proper clearance around your furnace and water heater.

Check and clean your dryer vent.

Always follow manufacturers’ instructions when using space heaters.

Never leave a burning candle unattended.

Install a carbon monoxide alarm near the sleeping areas of your home.

Trash Pick-up - In order to maintain the neat appearance of our community we request that you put your trash out only on the evening prior to the scheduled pick-up day. Trash containers and miscellaneous trash are to be stored in the garage. They should not be placed on sidewalks, driveways, next to garages or behind walls except on pick-up day.  Everything must be in sealed bags or trash containers with the lids on.  PLEASE BE SURE bags are sealed and lids are on tight.
